Terms and Conditions for Joseph Casson Estate Agency.
1. Introduction
1.1 These terms and conditions ("Terms") apply to the use of the services provided by
Joseph Casson Estate Agency ("the Agency") to clients seeking to buy, or sell
properties.
1.2 By using the Agency's services, you agree to be bound by these Terms, which
form a legally binding agreement between you and the Agency. If you do not agree
to these Terms, you should not use the Agency's services.
2. Services Provided
2.1 The Agency provides estate agency services, including the marketing, advertising
and sale of properties.
2.2 The Agency may also provide additional services, such as property management,
property valuations, and financial services.
2.3 The Agency reserves the right to alter the services it provides at any time, without
prior notice to clients.
3. The Agency & Referral Fees
3.1 The Agency charges fees for its services, which are set out in the Agency's fee
schedule.
3.2 The Agency's fees are due and payable upon the completion of a sale or rental
transaction, or at such other time as agreed in writing between the Agency and the
client.
3.3 The Agency reserves the right to alter its fee schedule at any time, without prior
notice to clients.
3.4 The Agency reserves the right to charge a referral fee to the provider of
additional services, the fee charged ranges from £50 to 10% of business generated.
The Agency has gone to great lengths to ensure they are recommending high quality
providers and the fees customers pay would be the same whether referred by The
Agency or by going direct to the provider.

Financial Services: Cooper Associates
Residential Surveys: GB Home Surveyors
Conveyancing: Alletsons, Amicus Law, Risdon Hosegood, Barrington & Sons,
Setfords.
Auctions: Iamsold
4. Client Obligations
4.1 The client must provide the Agency with accurate and complete information
about the property to be sold, and any other information required by the Agency.
4.2 The client must keep the Agency informed of any changes to the information
provided and must inform the Agency immediately if the property is no longer
available for sale.
5. Agency Obligations
5.1 The Agency will use reasonable care and skill in providing its services to clients.
5.2 The Agency will keep confidential all information provided by clients and will not
disclose such information to any third party without the client's prior written consent,
except where required by law.
6. Liability
6.1 The Agency shall not be liable for any loss or damage suffered by clients as a
result of its services, except where such loss or damage is caused by the negligence
or wilful misconduct of the Agency.
6.2 The maximum liability of the Agency under these Terms shall be limited to the
amount of fees paid by the client to the Agency for its services.
7. Termination
7.1 Either party may terminate these Terms by giving written notice to the other
party.
7.2 Upon termination of these Terms, the Agency shall return to the client any
property or documents in its possession belonging to the client.
8. Dispute Resolution
8.1 Any dispute arising out of or in connection with these Terms shall be referred to
arbitration, in accordance with the rules of the Chartered Institute of Arbitrators.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of
England and Wales.
10. Entire Agreement
10.1 These Terms constitute the entire agreement between the parties and
supersedes all prior agreements, understandings and negotiations between them,
whether written or oral.
11. Variation
11.1 No variation of these Terms shall be effective unless it is in writing and signed
by both parties.
12. Waiver
12.1 No failure or delay by either party in exercising any right, power or remedy
under these Terms shall operate as a waiver of that right
